TERMS & CONDITIONS

General:

1. Abbreviations and Meaning: In these conditions OTT shall mean Over The Top Tours Ltd, a registered UK company, number 04599857 with registered offices at 46 Queen Street, Deal, Kent CT14 6EY.

The term "First Name" refers to the person making the booking and identified on the Booking Form. "Party", "Group", "Client" or "Your" means those persons listed on the Booking Form on behalf of whom the booking is made.

2. EU Package Regulations: All aspects of your holiday conforms with the Package Travel, Package Holidays and Package Tour Regulations, 1992 in accordance with EEC Directive on Package Holidays 90/314. All monies received by OTT will be held in a separate trust account with Clydesdale Bank plc, Bridge of Don Branch, Aberdeen and as such cannot be released until the specified tour has taken place. This regulation guarantees a full refund of all monies paid in the unlikely event of OTT failing to provide the tour booked.

3. OTT Cancellation: Should a tour be cancelled by OTT for whatever reason, including under-subscription, clients will have the choice of accepting an alternative tour or receiving a full refund of all monies paid including the deposit.

4. Client Cancellation: Should the client cancel a booking the First Name client must notify OTT in writing and the cancellation will be effective from the date the written cancellation is received by OTT. The following scale of cancellation charges shall apply relative to the departure date of the tour.

5. Payment: there shall be no contract between OTT and the client until the required deposit and Booking Form have been received by OTT. A confirmation invoice will then be sent to the client. Final settlement of the Confirmation Invoice must be made not less than 56 days before the tour departure date.
Payment by cheque should be made out to "Over The Top Tours Ltd".

6. Insurance: It is a condition of the contract between clients and OTT that all clients should have travel insurance. OTT provides insurance cover at the following rates and the option for this insurance is contained on the Booking Form. Clients may seek their own travel insurance cover but OTT will need details of such cover prior to departure. A copy of the insurance conditions will be sent to clients with the Booking confirmation invoice. Insurance premiums are non-refundable.

OTT Insurance cover is : Up to and including 7 days cover = £20 per person.

7. Force Majeure applies to these conditions, meaning unusual and unforeseen circumstances beyond the control of OTT and including - but not limited to - riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, flood, fire, adverse weather conditions or the threat of any of these unforeseen circumstances.
